Bryan John Ellicott, 24, a transgender man, has sued the New York City Department of Parks and Recreation for discrimination, saying staff at a public pool told him to use the women’s locker room. The lawsuit asks the court to rule for the first time that denying transgender people use of a restroom or locker room that matches their gender identity is discrimination in violation of New York City human rights law, which bans discrimination based on “gender,” which include actual or perceived sex and a person’s gender identity, self-image, appearance, behavior or expression, whether or not that gender identity, self-image, appearance, behavior or expression is different from that traditionally associated with the legal sex assigned to that person at birth.

    Below are a few of my thoughts. I apologize for the caps.

    IT IS A HUMAN RIGHTS VIOLATION. The people who are being denied the basic and fundamental human right of personal privacy when they are undressing or are nude are being stripped of their rights. Moreover, nothing that anyone does can prove that the emotional suffering caused by being nude in the presence of a member of the opposite sex is more important than “gender identity”.

    (1.) The males should sue for their emotional suffering. Indeed, every male who has his privacy rights violated should sue.

    (2.) Truth be told, no state has any precise definition of “gender identity” anyway. It can and does change, and people can define it in whatever manner they so choose.

    If we rule out disorders of sexual development (DSD IS NOT THE SAME THING AS TRANSGENDER), THERE IS NO SUCH THING AS “ACTUAL OR PRECEIVED SEX”. The human species is sexually dimorphic and all primates reproduce sexually.

    (3.) What exactly is a self-image, behavior or appearance that makes one a “woman” or a “man”? There is no way to even ask this question without dredging up traditional sex stereotypes.

    ‘GENDER IDENTITY” IS CODIFYING SEX BASED STEREOTYPES INTO LAW, AND MOST PEOPLE WOULD AGREE THAT SEX STEREOTYPES ARE OFFENSIVE.

    (4.) IF FEMALES CAN UNDRESS IN FRONT OF MEN, THEN MALES CAN SHOWER AND UNDRESS WITH WOMEN.

    WE HAVE ALREADY SEEN EXAMPLES OF “GENDER IDENTITY” LAWS BEING ABUSED, AND ADULT MALES EXPOSING THEIR MALE GENITALIA TO TEENAGE GIRLS. CHRISTOPHER, “JESSICA”, HAMBROOK ALREADY SEXUALLY ASSAULTED WOMEN WHILE LIVING IN WOMEN’S SHELTERS.

    (5.) THERE ARE ALSO REAL SAFETY ISSUES. HOW BIG IS THIS FEMALE IN COMPARISON TO THE AVERAGE MALE? If this female is sexually assaulted in a men’s locker room, could she defend herself?

    (6.) IF THIS FEMALE HASN’T UNDERGONE “BOTTOM SURGERY” OR A PHALLOPLASTY, MALES ARE GOING TO THINK IT’S STRANGE THAT A “GUY” COMPLETELY LACKS A PENIS AND TESTICLES.

    (7.) DOES SHE STILL HAVE BREASTS? I’M SURE MEN IN THE LOCKER ROOM WILL NOTICE THIS.
