Shea, a transgender woman, applied to be a correctional officer at a south western state correctional institution. Shea passed all required exams and fitness tests, and the agency’s recruiters knew Shea was transgender. When it came time for her to enroll in the correctional officer academy however, Shea was informed that she could not enroll because her “anatomy was not clearly male or female.” In other words, because Shea had not yet had a sexual reassignment surgery, she was prohibited from working as a C.O. in the men’s facility where she was scheduled to start work. She was also prohibited from working as a C.O. at a women’s state prison.  Shea mediated the dispute with the Equal Employment Opportunity Commission, as discrimination based on gender identity is illegal.

Gender Identity Watch supports this decision, as discrimination based on gender identity or sex stereotypes is sex discrimination and is unlawful under Title VII.

  1. A U.S. Army vet with a college degree in criminal justice and experience in loss prevention, she was excited to begin her lifelong dream of a working in corrections – a career that allowed her to use her knowledge and experience and that provided a solid income with excellent
    benefits.

    I’m assuming this individual is a male Army vet. The Army does routine physicals on all its soldiers. Since this individual is male, there is no “her”. Apparently, he took some female hormones, but he still has male genitalia.

    I don’t have any problem with him working in a men’s prison. After all, he is a male Army vet, and still has his penis. A women’s prison is another matter. That is, if he plans on working in a female facility.

    He still has his male genitalia and expects to use the same restroom as female correctional officers. HELL NO! It’s a violation of the privacy rights of female employees.

    Erasing the female sex as a distinct class of persons and replacing it with gender identity is the most odious form of sex discrimination. Moreover, it’s impossible to even talk about gender identity without dredging up sex stereotypes. Claiming “gender identity” is sex discrimination because for all practical purposes it’s based on sex based stereotypes.
